SPANISH FORK — Three weeks after he was arrested for having child pornography, an attorney who used to work for the Child Protection Division of the Utah Attorney General’s Office was arrested again for making child pornography.

Gary Lee Bell, 66, of Spanish Fork, was arrested Tuesday by Utah County sheriff’s deputies. They are looking into 12 counts of sexual exploitation of a minor, aggravated sexual abuse of a child, and sodomy on a child.

Bell was arrested in August by detectives from the Utah County sheriff’s Special Victims Unit. They said they found images of child pornography on electronic devices Bell owned. This happened after the National Center for Missing and Exploited Children told detectives that child pornography was being downloaded.

After getting a search warrant, detectives went to Bell’s house, where they arrested Bell and “took several electronic devices.” Bell was put in jail, where he stayed until a judge let him out on Sept. 6 with the condition that he wear a GPS tracker.
On Tuesday, a sheriff’s detective looked at the information on a micro SD card that belonged to Bell. This was done after a forensic technician gave them the information taken from the devices that were taken from Bell in August. A police booking affidavit says that when the detective looked at the data, he found “a series of nine photos” showing a man hurting a child.

“Detectives think that Bell made these pictures and videos, and that he didn’t just get them from somewhere else,” said Utah County Sheriff’s Sgt. Spencer Cannon in a statement.

In the affidavit, the detective said that they recognized things in the background of the images from photos taken by crime scene technicians when the warrant was served on August 24.

According to the affidavit, when the detective looked into it more, he found a video file that showed the abuse and more photos of a child. “I looked at the EXIF data for both photos, which shows what device was used to take the photos and when they were made. Both photos were taken on a Samsung phone with the model number SM-A10201. This is the same phone that was taken from Gary during the warrant service.”

The affidavit said that there are “hundreds” of photos of Bell on the extraction and that the video looks like “full-naked photos” that Bell took of himself.

On Tuesday, Bell was sent back to the Utah County Jail.

“It’s even scarier for anyone who has talked to Mr. Bell to know that, in addition to downloading material made by others, he may also be making similar material, like photos and videos, of people he has sexually abused,” Cannon said.

Bell will be held without bail because a judge said so.

Police said Bell left his job at the Utah Attorney General’s Office, but the office said he quit in 2020 but wouldn’t say why. He worked as a prosecutor in the Child Protection Division, but the office said that he did not bring cases to court.

COLLEGE STATION, Texas James McCoy Taylor, a Texas singer, songwriter, and reality TV contestant, was arrested early Saturday morning in the Northgate district. He was charged with Driving While Intoxicated and Unlawful Carrying of a Weapon and was taken to the Brazos County Detention Center.

Online jail records show that 36-year-old Taylor from Katy was freed later that day after posting a $6,000 bond.

According to a probable cause statement filed by College Station Police, Taylor was first talked to around 2:45 a.m. in the Northgate Parking Garage by a Blinn College Police Officer who was there on an off-duty job.

The officer said that Taylor was peeing in the parking lot near his 2012 Ford F150 pickup truck. The police officer talked to Taylor and told him not to urinate near the truck. He also told James not to drive the Ford F150. Taylor told the officer that he wouldn’t drive and would find another way to leave, but the report says that just a few minutes later, he went back to his pickup truck and drove away.

When College Station police were called, Taylor was driving through the garage toward the exit gate. He told the officer he was just trying to move his truck to a different part of the parking garage so he could get better cell phone service, according to the arrest report.

Police say that they had to reach into the truck and turn off the ignition. They then told Taylor to get out of the truck.
After Taylor failed field sobriety tests, police stopped him for driving while drunk.

During the arrest, police said he was rude to the officer and called him things like “an idiot.” He also said he would try to get the officer fired and file charges.
The police found a gun in the pocket of the driver’s door in Taylor’s truck. Under Texas law, it is against the law to carry a weapon while doing something illegal, like driving while drunk.
Taylor is a singer and songwriter who may be best known for his appearance on Season 12 of The Bachelorette. Last year, he made headlines all over the country when he said he was going to sue several news outlets because they had wrongly said he was part of the January 6 capitol riot. A post on Taylor’s Instagram page says that he will be at the Texas Youth Summit in The Woodlands at the end of the month.

Officers said Taylor had glassy eyes, slurred speech, and smelled like alcohol while standing. He also swayed back and forth. He is said to have told police that he had been drinking at Northgate and had six drinks between 10 p.m. Friday and 1 a.m. Saturday at different bars.

In their arrest report, the police also wrote that Taylor had just met an 18-year-old “college freshman companion” at Northgate, and he planned to drive her back to her dorm room. In the report, the police also said that she was drunk and “was not in any way able to weigh the pros and cons of the situation she was in.”

Today, my former student, Pieper Lewis bravely took the microphone during her sentencing hearing and told the courtroom that her voice mattered. I was incredibly proud of her. She was powerful, and she brought me to tears. The judge then studied all the evidence in Pieper Lewis’ case carefully and decided that she did not deserve to spend time in an adult prison. Instead, he gave her five years of probation. He decided that 834 days she spent in juvenile detention awaiting her sentencing was enough “punishment” for a then fifteen-year-old girl who had been kicked out of her home and found herself sleeping in the stairwell of one of the most dangerous apartment complexes in Des Moines; a girl that was ultimately preyed upon by men twice her age who traded her body for drugs. These men physically asualted, raped, and sex trafficked Pieper on multiple occasions. On June 1st, 2020, Pieper snapped and killed one of the men who exploited and raped her, stabbing him to death.
Today, the judge recognized that Pieper was a victim and a child. He, like almost everyone who knows the details of Pieper’s case, empathized with a girl with no violent history before or after this incident, who saw killing a man as the only way out of a truly horrific situation. He granted her probation and a deferred judgement—meaning if she meets the conditions of her parole, she will have the felony removed from her record. This is a compassionate outcome.
Yet, Pieper only found herself in this situation because she was initially charged as an adult with 1st degree murder. DMPD and the Polk County prosecutor’s office saw Pieper immediately as a grown, violent, adult, murderer, and they charged her as such. Only because a team of amazing people came to Pieper’s side, was her story truly heard and understood. However, with the risk of life in prison looming, Pieper pled guilty to charges of manslaughter and willful injury. This was to avoid a risky trial where her team feared an Iowa jury may implicitly struggle to see a young black girl as the victim of sex trafficking that she was.
Today, it appears that the decision to put Pieper’s fate in the hands of a judge, as opposed to a jury, was a good one. Pieper will avoid prison, and she will have access to some of the services she needs to continue healing. However, in Iowa, there is a law that states that anyone who is convicted of killing a person, regardless of circumstances, must pay that individual’s family 150,000 dollars. This law is intended to provide justice to families who lost their loved ones. However, in the case of Pieper, it will require her to pay 150,000 dollars to the family of a man who purchased Pieper’s fifteen-year-old body from a sex trafficker, gave her drugs and alcohol, and then raped her repeatedly.
Pieper does not owe that man’s family justice. Pieper does not deserve to be finically burdened for the rest of her life because the state of Iowa wrote a law that fails to give judges any discretion as to how it is applied. This law doesn’t make sense in many cases, but in this case, it’s morally unjustifiable. A child who was raped, under no circumstances, should owe the rapist’s family money.
Pieper has five years of probation ahead of her; five years that she will be required to be nearly perfect to avoid facing 20 years in prison. She will do hundreds of hours of community service each year. She will be subject to drug testing, required to take classes, and attend therapy. Pieper’s path to true freedom will not be easy, and she is still a teenager that has experienced a lot of trauma.
Pieper wants to go to college, she wants to create art, and she wants to advocate for other girls who find themselves in situations like she endured. She does not deserve a massive debt looming over her, holding her back from pursuing her ambitions.
Our system if broken. It will take decades of advocacy and electing people committed to rethinking and reimagining our criminal justice system, especially our juvenile one, to fix the system. In the meantime, Pieper needs us now. If you are able, please donate to help Pieper!
**Update: As the Donations have increased, I am overjoyed with the prospect of removing this burden from Pieper. I have increased the goal and will continue accepting donations above the 200k if we get to that point. The funds will be used in the following ways: 1) Pay off Piepers 150k restitution 2) Pay off the additional 4k in restitution to the state 3) Remove financial barriers for Pieper in pursuing college/university or starting her own business. 4) Give Pieper the financial capacity to explore ways to help other young victims of sex crimes! Thank you! You are all amazing.

What Are the Most Common Causes of Semi-Truck Accidents https://24hrlegalpro.com/2022/09/15/what-are-the-most-common-causes-of-semi-truck-accidents/ https://24hrlegalpro.com/2022/09/15/what-are-the-most-common-causes-of-semi-truck-accidents/#respond Thu, 15 Sep 2022 02:31:19 +0000 https://24hrlegalpro.com/?p=1337 The post What Are the Most Common Causes of Semi-Truck Accidents appeared first on 24 Hour Legal Pro.

]]>

Based on reports from the Federal Motor Carrier Safety Administration, the National Highway Traffic Safety Administration, and the Insurance Institute for Highway Safety, the most common things that lead to truck accidents are:

Speeding \Fatigue \Distraction
Driving while drunk or high
Vehicle failure
Cargo not properly tied down

Most truck accidents happen because of speeding, whether it’s going over the speed limit or going too fast in bad weather. Speeding truck accidents are often caused by things like following too close, changing lanes wrong, and moving around illegally.
Fatigued driving, which is another name for drowsy driving, is always a worry on the road. There are laws that say how long a truck driver can drive before they have to stop and rest, but some truck drivers may break these laws to get to their destination faster. Fatigue can slow down your reactions, make you lose focus, and even cause you to fall asleep at the wheel.
Distracted driving is a big problem on the highways in general, but it’s even more dangerous for big trucks. This includes eating, talking on a cell phone, reading, and fiddling with the radio. Every year, distractions cause tens of thousands of accidents. Distractions can make it hard to pay attention to possible dangers like rough roads, other cars, or stop lights.
Alcohol isn’t the only thing that can make it hard to drive. This can be done by taking opiate painkillers, marijuana, illegal drugs like cocaine and speed, or any other drug that makes it hard to think and move quickly. It is against the law for a truck driver to use these drugs because they could cause an accident.
In this way, the accident may have been caused in part by someone other than the truck driver. Most truck companies have maintenance crews whose job it is to make sure the truck is safe to drive, but this doesn’t always happen. In fact, a study from 2010 showed that almost 55% of trucks that were checked after a crash had a safety-related mechanical problem, and almost 30% of those trucks should not have been on the road at all. Most likely to break are the tires, brakes, wheels, powertrains, lighting, and coupling systems.
When the truck stops too quickly or makes a sharp turn, cargo that hasn’t been properly secured can spill or move. This can throw the truck’s balance off and cause it to jackknife or roll over, which can be very dangerous. In this case, the loading crew might have done something wrong by not making sure the cargo was safe.

Firefighters from Toombs County were able to save a semi-truck driver from a fire that was about to start when his truck caught fire after an accident on Georgia State Route 130. In the late afternoon of September 9, an 18-wheeler went off the road, flipped over, and ended up in a ditch next to the road. The driver of the car, who hasn’t been named by police, was stuck in the wreckage and had to be freed by the Toombs County Fire Department using “the jaws of life” and other tools. Captain Robert Tillman of the Toombs County and Vidalia Fire Departments praised how well law enforcement and emergency services agencies in the area work together. “When the call came in, I told Firefighter Ray Mc-Donald, who lives in Petross, to go to the scene right away and take a look at what was going on,” Tillman said. “Firefighter McDonald knew right away that the driver was stuck under the truck and that we would need a lot of help.”

Tillman said that when he heard this, he called Lieutenant Jonas Blackwell and asked him to send several fire trucks and tools to the scene. When Tillman got there, he saw how hard the rescue would be. The truck still had power going to it, but it was leaking diesel fuel, and the frame was upside down and in a weighted position that made it hard to remove. “Right away, we put a guy on the ground in full gear so that if anything went wrong, he could respond and put out the fire,” Tillman said. “As I looked at the wreckage, I realized I needed Cooper’s Towing, which was close by.” Tillman says that he realized a tow truck was needed for the rescue because he had seen the TV show “Heavy Rescue,” in which rescue workers used wreckers to lift things. The firefighters called Cooper’s for help and kept checking on the person who was stuck until the truck arrived. When the tow truck got there, it lifted the truck slowly so that firefighters and other helpers could make small changes to make sure the victim was safe, like cutting the hood off the truck to keep the driver from getting hurt more. “We lifted it just enough so we could go in and get the victim, but as soon as we did, the truck caught on fire,” Tillman said. “One group of firefighters put out the fire, while another tried to get the person out. I could only think, “I’m not going to let my patient die and burn to death.” The group pulled the man to safety by working together. Tillman praised the team’s work. “They never flinched or ran away when things got hard. He said, “They stayed and did what they had been taught to do.”
